Shipping Protection

1. Definitions
For purposes of this Shipping Protection Policy ("Policy"), the following definitions shall apply:
- "Company" means Cosmic Peptides, LLC, a Texas limited liability company, including its members, managers, officers, employees, agents, and affiliates.
- "Customer" means the individual or entity that places an order through the Company's website and purchases Shipping Protection.
- "Shipping Address" means the delivery address provided by Customer at the time of checkout and recorded in the Company's order management system.
- "Carrier" means USPS, UPS, FedEx, DHL, or any other shipping carrier utilized by Company to transport Customer's order.
- "Ship Date" means the date on which Carrier first scans or accepts the package into its possession, as reflected in the official tracking record.
- "Delivery Scan" means any notation in Carrier's tracking system indicating delivery, including but not limited to "Delivered," "Left at front door," "Left with individual," "Delivered to mailbox," "Parcel locker," signature capture, or any similar confirmation.
- "Lost in Transit" means a shipment for which: (a) Carrier's official tracking system contains no Delivery Scan; (b) Carrier has officially declared the package lost following completion of its internal trace investigation; and (c) a minimum of ten (10) business days have elapsed since the Ship Date. All three conditions must be satisfied.
- "Carrier Misdelivery" means a shipment that Carrier delivered to a physical address other than the Shipping Address, due solely to Carrier error, as confirmed by Carrier records, GPS data, photographic evidence, or written Carrier acknowledgment.
- "Eligible Order" means an order for which Customer purchased Shipping Protection at checkout, prior to shipment, and for which all eligibility requirements set forth herein are satisfied.
2. Scope and Nature of Shipping Protection
Company offers an optional Shipping Protection service ("Shipping Protection") that provides limited coverage for Eligible Orders that are Lost in Transit or subject to Carrier Misdelivery. BY PURCHASING SHIPPING PROTECTION, CUSTOMER ACKNOWLEDGES HAVING READ, UNDERSTOOD, AND AGREED TO BE BOUND BY ALL TERMS AND CONDITIONS SET FORTH HEREIN.
SHIPPING PROTECTION IS NOT INSURANCE. Shipping Protection is a voluntary service fee that entitles Customer to a one-time reshipment or refund, subject to the terms, conditions, limitations, and exclusions described in this Policy. Shipping Protection does not constitute an insurance product, is not underwritten by any insurance company, and does not create any insurance contract or relationship between Customer and Company or any third party.
CRITICAL LIMITATION: Shipping Protection covers ONLY: (1) packages confirmed Lost in Transit, and (2) packages subject to verified Carrier Misdelivery. Shipping Protection provides NO coverage whatsoever for packages bearing a Delivery Scan to the Shipping Address, regardless of what occurs after delivery. The distinction between "Lost in Transit / Carrier Misdelivery" and "delivered then stolen" is absolute and non-negotiable.
3. Covered Events
Shipping Protection covers the following two (2) events ONLY:
3.1 Lost in Transit
A shipment qualifying as Lost in Transit under Section 1, provided:
- Carrier's official tracking record contains no Delivery Scan;
- A minimum of ten (10) business days have elapsed since the Ship Date;
- Customer has submitted a complete and truthful claim in accordance with Section 6; and
- Company has verified the lost status through inquiry with Carrier.
3.2 Carrier Misdelivery
A shipment qualifying as Carrier Misdelivery under Section 1, provided:
- Carrier's records, GPS data, photographic evidence, or written acknowledgment confirm delivery to an address other than the Shipping Address;
- A minimum of seven (7) business days have elapsed since the misdelivery to permit Carrier recovery attempts;
- Customer has submitted a complete and truthful claim in accordance with Section 6; and
- Company has verified the Carrier Misdelivery through inquiry with Carrier.
CLARIFICATION: Carrier Misdelivery coverage applies exclusively to Carrier error. Coverage does NOT apply when: (a) Customer provided an incorrect, incomplete, or undeliverable Shipping Address; (b) the package was delivered to the Shipping Address and subsequently stolen; (c) the package was delivered to a neighbor, building mailroom, leasing office, concierge, or parcel locker at or near the Shipping Address; or (d) Customer failed to retrieve a properly delivered package.
NO OTHER EVENTS, CIRCUMSTANCES, OR SCENARIOS ARE COVERED UNDER ANY INTERPRETATION OF THIS POLICY.
4. Exclusions
THE FOLLOWING ARE EXPRESSLY AND UNAMBIGUOUSLY EXCLUDED FROM COVERAGE. COMPANY SHALL MAKE NO EXCEPTIONS UNDER ANY CIRCUMSTANCES:
4.1 Packages Delivered to the Shipping Address
ANY PACKAGE BEARING A DELIVERY SCAN TO THE SHIPPING ADDRESS IS EXCLUDED FROM COVERAGE. Once Carrier's tracking system reflects delivery to the Shipping Address, the package is deemed delivered and is permanently and irrevocably excluded from Shipping Protection. The sole exception is verified Carrier Misdelivery as defined in Section 3.2. This exclusion applies regardless of:
- Whether Customer personally received or observed the package;
- Whether the package was stolen subsequent to delivery;
- Whether Carrier left the package in an unsecured location;
- Whether the package was left with a neighbor, front desk, mailroom, or third party;
- Whether Customer disputes the accuracy of the Delivery Scan;
- Whether Carrier's GPS data appears inconsistent with the Shipping Address;
- Whether Carrier failed to capture photographic proof of delivery; or
- Any other circumstance arising after the Delivery Scan.
COMPANY DOES NOT COVER PORCH PIRACY, THEFT AFTER DELIVERY, OR "DELIVERED BUT NOT RECEIVED" SCENARIOS. THIS EXCLUSION IS ABSOLUTE AND NON-WAIVABLE.
4.2 Damaged Packages
Packages arriving damaged, broken, crushed, leaking, or otherwise compromised are excluded from Shipping Protection. Damage claims are governed exclusively by Company's Shipping Policy.
4.3 Address Errors
Packages undeliverable due to errors, omissions, or deficiencies in the Shipping Address are excluded. This includes typographical errors, missing unit numbers, outdated addresses, inaccessible locations, and packages returned to sender due to address deficiencies.
4.4 Refused, Unclaimed, or Returned Packages
Packages refused upon delivery, unclaimed at Carrier facilities, or returned to Company for any reason attributable to Customer are excluded.
4.5 Delayed Packages
Packages delayed in transit but eventually delivered are excluded. Shipping Protection provides no remedy for delivery delays regardless of duration or cause.
4.6 Delivery to Adjacent or Authorized Locations
Packages delivered to neighbors, building mailrooms, leasing offices, concierges, doormen, front desks, parcel lockers, or any person or location at or near the Shipping Address constitute valid delivery and are excluded from coverage.
4.7 Prohibited Destinations
Orders shipped to freight forwarders, international reshipping services, package consolidators, or P.O. Boxes (where prohibited) are excluded.
4.8 Orders Without Shipping Protection
Orders for which Customer did not purchase Shipping Protection at checkout are ineligible for benefits under this Policy. Shipping Protection cannot be added retroactively.
4.9 Fraudulent or Bad-Faith Claims
Claims determined by Company, in its sole discretion, to be fraudulent, abusive, deceptive, or made in bad faith are excluded and may result in account termination and referral to law enforcement. See Section 8.
5. Fees
Shipping Protection is offered at checkout for a non-refundable fee determined by order subtotal (excluding shipping and taxes):

NON-REFUNDABLE: The Shipping Protection fee is non-refundable once the order has shipped, regardless of whether a claim is filed or approved. The fee shall be refunded only if the order is cancelled prior to shipment.
6. Claims Procedure
Customer must comply with the following procedure to submit a claim:
6.1 Waiting Period
Lost in Transit: Customer must wait a minimum of ten (10) business days from the Ship Date before submitting a claim.
Carrier Misdelivery: Customer must wait a minimum of seven (7) business days from the date of misdelivery to permit Carrier recovery attempts.
Claims submitted prior to expiration of the applicable waiting period shall be denied without review.
6.2 Claim Submission
Customer shall submit claims via email to customercare@cosmicpeptides.com with subject line: "Shipping Protection Claim – [Order Number]"
Lost in Transit claims must include:
- Customer's full name and order number;
- Tracking number;
- Screenshot of current tracking status demonstrating absence of Delivery Scan; and
- Written statement affirming that the package was never delivered and Customer has not received it through any means.
Carrier Misdelivery claims must include:
- Customer's full name and order number;
- Tracking number;
- Evidence of Carrier Misdelivery (delivery photograph showing incorrect location or other documentation); and
- Written statement affirming that Customer has not received the package.
IMPORTANT: Customer shall NOT file claims, traces, or investigations directly with Carrier. Company will conduct all Carrier communications and investigations. Customer-initiated Carrier claims may delay or jeopardize the resolution process.
6.3 Claim Deadline
Claims must be submitted within twenty-one (21) calendar days of the Ship Date. Claims submitted thereafter are permanently barred.
6.4 Verification
Company shall verify all claims through direct inquiry with Carrier. Company reserves the right to request additional documentation and to deny claims that cannot be verified to Company's satisfaction.
7. Claims Resolution
Upon approval of a claim, Company shall reship Customer's order subject to the following terms:
7.1 Reshipment
Company shall reship the products from Customer's original order at no additional cost. Shipping Protection entitles Customer to reshipment only; refunds are not available under this Policy.
7.2 Product Availability
If any products from Customer's original order are out of stock at the time of claim approval:
- Company shall reship all available products immediately;
- For unavailable products, Company shall, in its sole discretion, either:
- Hold the reshipment of unavailable items until stock is replenished, provided replenishment is expected within thirty (30) days; or
- Issue a partial refund for unavailable items if replenishment is not expected within thirty (30) days or at Company's discretion.
Company shall notify Customer of product availability status and the selected resolution method. Customer acknowledges that the determination of expected restock timing and selection of resolution method are at Company's sole discretion.
7.3 Exclusive Remedy
RESHIPMENT AS SET FORTH HEREIN CONSTITUTES CUSTOMER'S SOLE AND EXCLUSIVE REMEDY UNDER THIS POLICY. In no event shall Company be liable for consequential, incidental, special, punitive, or indirect damages of any kind, including but not limited to lost profits, research delays, project interruptions, or any other damages arising from or related to lost or misdelivered shipments.
7.4 Processing
Approved claims are processed within five to ten (5–10) business days. Reshipments are subject to standard processing and transit times.
7.5 Single Claim Limitation
Customer may file only one (1) claim per order. Upon resolution of a claim (whether approved or denied), no further claims shall be accepted for that order.
8. Fraud Prevention
FRAUDULENT CLAIMS CONSTITUTE THEFT AND SHALL BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.
Company employs fraud detection systems and maintains comprehensive records of all transactions, claims, and communications. Company actively monitors for abuse patterns including:
- Multiple loss claims from the same Customer or Shipping Address;
- Claims filed proximate to Delivery Scans;
- Coordinated schemes involving multiple accounts;
- False statements or falsified documentation; and
- Social engineering attempts directed at Company personnel.
CONSEQUENCES: Upon determination that a claim is fraudulent, abusive, or made in bad faith, Company reserves the right to:
- Deny the claim without further review;
- Permanently terminate Customer's account;
- Report fraudulent activity to law enforcement;
- Pursue civil litigation to recover damages, costs, and attorney's fees;
- Share fraud data with industry databases and other merchants; and
- Cooperate with criminal prosecution.
FILING A FALSE CLAIM CONSTITUTES FRAUD AND MAY BE PROSECUTED UNDER APPLICABLE FEDERAL AND STATE LAWS, INCLUDING 18 U.S.C. § 1341 (MAIL FRAUD), 18 U.S.C. § 1343 (WIRE FRAUD), AND APPLICABLE STATE THEFT STATUTES.
9. Limitations and Disclaimers
9.1 No Guarantee of Approval
Purchase of Shipping Protection does not guarantee approval of any claim. All claims are subject to verification and the terms herein. Company reserves the right to deny any claim failing to satisfy eligibility requirements or that Company cannot verify to its satisfaction.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY'S TOTAL LIABILITY UNDER THIS POLICY SHALL NOT EXCEED THE ACTUAL COST TO RESHIP CUSTOMER'S ORDER. COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
9.3 No Warranty
SHIPPING PROTECTION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9.4 Modification
Company reserves the right to modify, amend, or discontinue Shipping Protection at any time without notice. Modifications apply to orders placed after the effective date. The terms in effect at the time Customer purchased Shipping Protection govern that order's coverage.
9.5 Severability
If any provision of this Policy is held invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
10. Governing Law and Dispute Resolution
This Policy shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Disputes arising under this Policy shall be resolved pursuant to the Dispute Resolution provisions in Company's Terms of Service, including the binding arbitration agreement and class action waiver contained therein.
11. Integration
This Policy is incorporated into Company's Terms of Service. In the event of conflict between this Policy and the Terms of Service, the Terms of Service shall control except with respect to matters specifically addressed herein. By purchasing Shipping Protection, Customer acknowledges having read, understood, and agreed to this Policy and the Terms of Service.
