Medicinal product by presentation

The European and British definition of a medicine: a substance presented as having properties for disease, or one that may be used to modify a physiological function.

Last reviewed · Editorial policy

Directive 2001/83/EC, copied into the United Kingdom's Human Medicines Regulations 2012, defines a medicinal product in two limbs. By presentation: any substance presented as having properties against disease in human beings. By function: any substance that may be used in human beings to restore, correct or modify a physiological function by a pharmacological, immunological or metabolic action.

The first limb turns on what the seller says and how the product looks, so a research peptide becomes a medicine the moment a claim is made for it. The second turns on what the substance does at the amount sold, which courts decide product by product. In cases of doubt, the Directive provides, medicines law applies.
