YOU AND COSMIC PEPTIDES AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR YOUR USE OF THE SITE (COLLECTIVELY, "DISPUTES") WILL BE RESOLVED BY BINDING ARBITRATION, EXCEPT THAT EACH PARTY RETAINS THE RIGHT TO SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF IN A COURT OF COMPETENT JURISDICTION TO PREVENT THE ACTUAL OR THREATENED INFRINGEMENT, MISAPPROPRIATION, OR VIOLATION OF A PARTY'S INTELLECTUAL PROPERTY RIGHTS.

The arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in San Antonio, Texas, unless you and we agree otherwise. Each party will be responsible for paying any AAA filing, administrative, and arbitrator fees in accordance with AAA rules. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorneys' fees, and reasonable costs for expert and other witnesses. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

14.3 Class Action Waiver

YOU AND COSMIC PEPTIDES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. UNLESS BOTH YOU AND WE AGREE, NO ARBITRATOR OR JUDGE MAY CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

14.4 Opt-Out Right

You have the right to opt out of binding arbitration within thirty (30) days of first accepting these Terms of Use by sending written notice of your decision to opt out to legal@cosmicpeptides.com with the subject line "ARBITRATION OPT-OUT." Your notice must include your name, address, and a clear statement that you want to opt out of this arbitration agreement. If you opt out, all other parts of these Terms of Use will continue to apply.

15. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or related to these Terms of Use or the Site shall be governed by and construed in accordance with the internal laws of the State of Texas, without giving effect to any choice or conflict of law provision or rule.

To the extent that arbitration does not apply, you and Cosmic Peptides agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Bexar County, Texas. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

16. Severability and Waiver
